By providing your information to access the Recreation Station you are agreeing to receive future updates from Pappas Way. By accessing the “Recreation Station” on the Pappas Way site and/or using any of the equipment made available therein (the “Equipment”), I acknowledge and agree that my entry into the Recreation station and my use of the Equipment is voluntary and at my own risk. In consideration for being allowed to access the Recreation Station, I hereby, to the fullest extent permitted by law, waive all claims against and release OPG MP Parcel Owner (DE) LLC, Oxford I Asset Management USA, Inc., and their respective partners, members, principals, officers, directors, agents, employees, contractors, successors and assigns (collectively, “Released Parties”) from, and agree to hold any and all of the Released Parties harmless against, any claim, demand, liability, cause of action or suit of any kind or nature, whether resulting from the negligence of the Released Parties or otherwise, arising out of, resulting from or incident to my accessing of the Recreation Station and my use of the Equipment. I further agree that the Released Parties shall not be responsible or liable for any articles damaged, lost or stolen in or about the Recreation Station, or for loss or damage to any property. I recognize that my use of the Equipment entails some risk of injury. I have consulted with my physician or taken such other steps as I feel are necessary to assure myself that my use of the Equipment will not have any negative effects on my health and wellbeing. I understand that the Recreation Station will not be staffed or supervised.
